1. Agreement to Our Terms

By using imagenx.art, you confirm that you are at least 13 years of age and legally able to enter into this agreement. If you do not agree with any part of these Terms, you may not use our Service.

2. The ImagenX Service

imagenx.art provides a platform that allows you to generate unique images using artificial intelligence. The quality and nature of the AI-generated content depend heavily on the prompts you provide and the inherent capabilities of our AI models.

3. Your Account and Commitments

Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

Accurate Information: You agree to provide true and accurate information when you register and to keep it updated.

Your Responsibilities: You are responsible for the text prompts and images you upload ("Inputs") and the videos you generate ("Outputs").

4. Rules of Conduct & Prohibited Use

You agree not to use the Service to create, upload, or share any content that:

Is illegal, hateful, harassing, or discriminatory.
Infringes on any third party's intellectual property rights, including copyright and trademarks.
Depicts non-consensual sexual content or graphic violence.
Is designed to mislead, such as generating misinformation or fake endorsements.
Attempts to reverse-engineer, decompile, or disrupt the integrity of our platform.

Violation of these rules may result in immediate account suspension or termination.

5. Content Ownership & Intellectual Property

You Own Your Content: You retain all ownership rights to the original content (Inputs) you upload to imagenx.art.

Ownership of Generated Images: For users on a paid plan, you own the images (Outputs) you create and can use them for personal or commercial purposes, subject to the rules in Section 4. Users on a free plan are granted a limited, non-commercial license.

Our Service IP: We retain all ownership rights to the imagenx.art platform, our logos, code, and the underlying AI models.

6. Credit Purchases, Payments, and Refunds

Paid Services: ImagenX offers one-time credit packs. Prices are displayed in USD, and NOWPayments provides the cryptocurrency checkout. Each purchase is a separate payment, with no monthly or annual billing and no automatic renewal.

Credits and Confirmation: Credits purchased through these packs do not expire. Credits are added only after sufficient, completed payment is verified by our server. Check the coin, network, address and amount at checkout before sending. Partial or incorrect transfers may require manual review. Previously purchased subscription access keeps its original end date; new credit purchases do not renew it.

Refund Policy: Refund requests are reviewed under our Refund Policy and applicable law. Cryptocurrency transfers cannot simply be reversed; any approved refund requires transaction and network review. Contact support@imagenx.art with your order ID.

7. Termination of Service

We reserve the right to suspend or terminate your access to imagenx.art at our discretion, without notice, for any violation of these Terms or for any activity that harms our platform or other users.

8. Service "As Is" Disclaimer & Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that the generated content will meet your specific expectations.

To the fullest extent permitted by law, imagenx.art and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you for any and all claims shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Your Country/State]. Any disputes arising from these Terms will first be addressed through informal negotiation. If a resolution is not reached, the dispute shall be resolved through binding arbitration in [Your City, State].
